When you run a check, your browser sends the name you entered, the markets you chose and whether you build software to our server. Our server then asks public sources about the name: domain registries and DNS, Companies House, EUIPO (EU trade mark register), GLEIF, SEC EDGAR, Wikidata, Bluesky, GitHub, npm, PyPI, crates.io, RubyGems, Docker Hub and the Apple App Store. Each of them receives the name, not your IP address or anything else about you.

For the review of language and sound, our server sends the name and the markets to OpenRouter, Inc. (USA), which passes them to an AI model of Anthropic PBC (USA). Here too, nothing about you is sent with the name.

Our server keeps a report in its memory for 24 hours, so that the same name is not asked again, and then deletes it. The check keeps no log of names or IP addresses. To limit the number of checks per IP address, it counts them in working memory only; nothing is written to disk.

A report has its own address with the name in it (/check/?name=…). Anyone you give this address can open the report.

A name for a company, product or brand is usually not personal data. If you check a name that is a person's name, it is processed in the same way. The legal basis is our legitimate interest in providing the check you ask for (Art. 6 (1) (f) GDPR). Trade mark results show data from the public EUIPO register: the words of the mark, its number, status, classes, filing date and the names of the owners. Owners can be natural persons, so these names can be personal data. We show them so that a founder can see whether a name conflicts with an existing mark (legitimate interest, Art. 6 (1) (f) GDPR); the register is public for the same purpose. Representatives are not shown. The data is kept only in the report cache for 24 hours and comes from the register again on the next check. Each mark links to its official record; corrections are made at the EUIPO. Owners can contact us at the address in the imprint with any request about their data.

When you open a page, your browser transmits technically necessary data to our server. The server stores in log files: your IP address, date and time of the request, the requested address, the status code and the amount of data transferred, the page you came from as far as your browser transmits it, and the identifier of your browser and operating system. For a report, the requested address contains the checked name.

We need these data to deliver the website, to find errors and to fend off attacks. The legal basis is our legitimate interest in a secure and working website (Art. 6 (1) (f) GDPR).

The log files are rotated daily and deleted automatically after 14 days. We do not analyse them into profiles and do not combine them with other data.

To see which pages are read and where visitors come from, our server counts visits itself. Nothing is stored in or read from your browser, and no script runs for it.

From your shortened IP address (the last part is dropped), the identifier of your browser and a random number that is created anew every day while the old one is deleted, the server forms a check value. With it, it recognises page views on the same day as one visit; from the next day on, visits can no longer be linked. With each page view it stores this check value, the page, the time, the website you came from (its name only, without the exact address), campaign details in the address, the type of device, the browser family and your preferred language. Your full IP address is not stored for this.

If you click a link to another website, the server counts the click and forwards you at once. We pass on nothing about you.

We delete the single page views after 14 days; after that only daily totals without reference to single visits remain. If your browser sends the signal "Global Privacy Control", we do not count your visit. The legal basis is our legitimate interest in improving the website based on its use (Art. 6 (1) (f) GDPR). The website and the check run on a server we rent from IONOS SE, Elgendorfer Str. 57, 56410 Montabaur, Germany, in a data centre in Germany. IONOS processes the data on our behalf under a data processing agreement (Art. 28 GDPR).

If you write to us or call us, we process your details to answer your request. The legal basis is our legitimate interest in answering requests (Art. 6 (1) (f) GDPR).

We delete your details as soon as we no longer need them and no statutory retention periods apply.

You have the right of access (Art. 15 GDPR), rectification (Art. 16 GDPR), erasure (Art. 17 GDPR), restriction of processing (Art. 18 GDPR) and data portability (Art. 20 GDPR).

You can object at any time to processing based on our legitimate interest (Art. 21 GDPR). An email to kontakt@soft-evolution.com is enough.

You can also complain to a data protection supervisory authority, for example the authority responsible for us in Lower Saxony (Die Landesbeauftragte für den Datenschutz Niedersachsen).
